We may decline an application, determine that our services are not currently a fit, or cancel or reschedule a consultation where reasonably necessary.

No obligation to purchase or provide services exists unless and until the parties enter into a separate written agreement where one is required.

4. Communications, Email, Telephone, and SMS

When you submit an inquiry, application, appointment request, or other form, you authorize Surge & Scale to respond to your request using the contact information you provide, subject to the consent choices presented to you and applicable law.

Depending on the interaction and the permissions you provide, communications may include:

The exact scope of services, program length, pricing, payment terms, advertising spend, client responsibilities, eligibility criteria, performance measurements, exclusions, cancellation rights, refund conditions, and guarantee requirements are established in the written services agreement presented for the applicable engagement.

If there is any conflict between website copy, advertising, a sales presentation, or other public marketing material and a signed written services agreement, the signed written services agreement controls.

References to a money-back or performance guarantee are subject to the complete written eligibility, measurement, client performance, attribution, timing, and refund conditions applicable to that offer.

Unless expressly stated otherwise in a signed agreement, advertising spend paid to advertising platforms is separate from Surge & Scale's program or service fees and is not part of a refund of Surge & Scale service fees.

6. Results, Testimonials, and Performance

From time to time, Surge & Scale may publish testimonials, case studies, performance examples, advertising metrics, revenue figures, appointment results, or other information concerning client experiences.

These examples describe particular circumstances and are not a representation that every customer will obtain the same or similar result.

Marketing and business results can be affected by many factors, including:

• Offer quality and pricing.

These Terms and disputes concerning only the use of Surge & Scale's public websites are governed by the applicable laws of Canada and the applicable laws of the province or territory in which Surge & Scale is legally established, without regard to conflict-of-law principles, except where mandatory consumer, privacy, or other laws require otherwise.

The governing-law, venue, dispute, arbitration, or other legal provisions of a separately signed services agreement control disputes relating to a paid client engagement.

15. Changes to These Terms

Surge & Scale may update these Terms from time to time to reflect changes to our websites, services, communications practices, technology, or legal requirements.
